Transcript Formatting - Should I include this?

    Transcript Formatting - Should I include this?

    This has never happened before, so I'm unsure as to how to handle this in the transcript. Almost at the end of a 5-day trial, during the closing argument of the prosecutor, the defendant's mom shouted from the audience her thoughts on some of the things the prosecutor was saying. She continued over my judge's orders to be quiet and finally he had her removed from the courtroom. First, do I even put this little dialogue in the transcript? And if so, do I identify her as Mrs. So and So and put what she said in colloquy (because she was a witness on the stand two days before that). Or, just put it in the transcript as a parenthetical of some sort? Thanks!

    I would put it in as colloquy as Ms. So and So, fwiw.

    Never did see you in Anaheim, btw.  See you in Chicago maybe?

    Hi Tami, Thanks for helping out. Unfortunately, I wasn't able to go to Anaheim. I had to cancel the first of June because I got hit with over 5500 pages of tran to get done by the end of August. So I've used this vacation time to get some of it done :( Thank goodness my family understood. My courtroom has been so busy. Some of the reporters and I are thinking about going to Chicago in October. That should be real nice. I should be caught up by then -- I hope.

    Angela, I always do AUDIENCE MEMBER.  I can't stand when that happens.  Yes, it should definitely be included in the transcript.  My judge would've had a contempt hearing for her LOL.

    Hi, Angela.

    FWIW, in case you need three confirmations, I agree - leave it in the transcript, put it in colloquy.   (I presume you were writing what you heard).   Since you know her name, I think identifying her as Mrs. So&So would be appropriate.  If you didn't know her name "audience member" or "unidentified speaker" would be fine.    And at the point she was removed from the courtroom, if the text didn't make it clear (judge saying something like "Please remove Mrs. So&so from the courtroom" for exampe) I think I'd put in a parenthetical that Mrs. So&so was removed from the courtroom.

    Thanks you guys for your help! And Doug, usually my judge will have a contempt hearing but I think he was just was so tired of this case -- we had two trials for the same defendant back to back. Plus, she was 77 or 78 years old!

    Unless I actually know the party's name (you do, she was a previous witness) I identify the speaker as INTERESTED PARTY and they go in as colloquy, sine the speaker is not sworn at the time.  It has to be included in the transcript since it might be grounds for declaring a mistrial for "tainting the jury" (or judge, if non-jury trial).
